Apple has lost the latest round of its legal battle with Samsung, after a US judge denied the Cupertino company a permanent injunction against 23 different Samsung devices.

Judge Lucy Koh reaffirmed a ruling she previously made in December 2012, saying Samsung’s iPhone look–alike devices had not caused Apple ‘irreparable harm’. That’s despite a US Federal ruling that Apple’s software patents may have been infringed.

With the 23 products in question now well out of date, it seems Apple’s legal arguments were an attempt to set a precedent before the two companies lock horns again later this month in a case involving more recent handsets.

It appears Apple may have a battle to match the multi–million dollar damages it was rewarded last time out. Koh is minded that Samsung’s phones provide ‘lawful competition’ to the iPhone, according to court documents.

Attempts to broker a deal between the two tech giants appear to have faltered. Talk earlier this year suggested the CEOs of both companies would sit down for negotiations to thrash out an out–of–court settlement.
