The Office of Communications (Ofcom) has cleared British Telecom (BT) of any wrongdoing in the recent phone price-fixing case brought against the organisation.
On April 26th 2005, an investigation was opened against BT by Ofcom following complaints by Binatone Telecom plc and an anonymous co-complainant of below cost price fixing by BT of its various models of branded cordless telephones.
Ofcom reached its decision on August 1st 2006 and concluded that BT had not infringed the Chapter II prohibition or Article 82 in relation to the pricing of its cordless telephones for the period between April 2004 and March 2005.
Among the conclusions from the telecommunications watchdog were that BT was not dominant in the relevant market for fixed line telephones in the UK.
Ofcom also undertook a detailed study of BT's prices and costs and concluded that – even if the company had been deemed as dominant – its pricing behaviour and strategy could not be defined as predatory pricing.
