The final rumblings of the long–running Apple vs Samsung lawsuit have taken a new twist, after officials in the US invalidated an Apple design patent.
The US Patent and Trademark Office has today stated that the patent-holder "is not entitled to benefit of the filing date" of a pair of older designs, noting that the design in question wasn’t shown in original drawings.
While this may not have any immediate effect, it could be a major boost to Samsung as it takes its fight against Apple to the Supreme Court.
The Korean giant recently lost an appeal to have the $548 million damages it owes Apple slashed by $400 million.
Backers such as Facebook and Google said that Apple winning the case would stifle innovation in the smartphone sector.
No date has been set for Samsung’s final appeal. However, this latest news means things could go on for longer than first anticipated.
